1. Introduction
This Privacy Policy explains how Wagerr Inc. (“Wagerr,” “we,” “us” or “our”) collects, uses, shares and protects information about you when you use the Wagerr mobile applications, websites and related services (together, the “Service”). It should be read alongside our Terms of Service.
By using the Service, you agree to the practices described here. If you do not agree, do not use the Service.
2. Who we are
Wagerr is a peer-to-peer platform for skill contests. Players agree the stakes, play their own round of a game, and the better unadjusted result wins. We provide the matching, scoring and settlement infrastructure. For the purposes of data-protection law, Wagerr Inc. is the controller of the personal information described in this policy. 3. Information we collect
We collect the following categories of information:
- Account information — the name, username, email address, date of birth and password you provide when you register.
- Identity-verification information — where required (for example, before a withdrawal), the identity documents and details processed by our verification provider to confirm who you are and your age.
- Location information — data used to confirm the jurisdiction you are in, so we can offer the Service only where it is permitted.
- Contest and gameplay information — the contests you join, the stakes you agree, the results you record, and related activity on the Service.
- Wallet and blockchain information — public wallet addresses you connect and the on-chain transactions associated with your contests.
- Payment and transaction information — limited information needed to facilitate adding or withdrawing value through third-party providers. Wagerr does not custody or hold fiat currency (see section 9).
- Device and usage information — device type, operating system, app version, IP address and similar technical information generated when you use the Service.
- Communications — messages you send us, including support requests.
4. How we use your information
We use the information we collect to:
- create and manage your account and provide the Service;
- match players, run and settle contests, and operate the escrow and scoring infrastructure;
- verify your identity, age and location, and meet our legal and regulatory obligations;
- detect, prevent and investigate fraud, cheating, collusion and other prohibited conduct;
- provide support and respond to your requests;
- maintain the security, integrity and performance of the Service; and
- send you service-related communications.
6. Blockchain and public data
Wagerr settles contests through non-custodial smart contracts on a public blockchain. Information recorded on a public blockchain — including wallet addresses and transaction details — is public, permanent and outside our control. It cannot be changed or deleted by Wagerr, and it may be visible to anyone and linked to you. Think carefully before connecting a wallet that can be tied to your identity.
7. Location data
We use location-verification technology to confirm the jurisdiction you are in and to block access where peer-to-peer skill contests for value are restricted. We use this information for eligibility, compliance and fraud-prevention purposes. Attempting to disguise or falsify your location breaches our Terms.
8. Identity verification (KYC)
Before certain actions, such as withdrawing funds, we use a third-party identity-verification provider to confirm your identity and age. That provider processes the documents and details you submit and returns a verification result to us. We use this to meet legal obligations and to protect the integrity of the Service.
9. Payments and fiat ramps
Wagerr does not custody, transmit, convert or hold fiat currency. To add or withdraw value, you use independent third-party payment and on/off-ramp providers. Those providers collect and process your payment information directly under their own privacy policies, and we encourage you to read them. We receive only limited information needed to facilitate and reconcile your transactions.
11. How long we keep data
We keep personal information for as long as needed to provide the Service and for legitimate business or legal purposes, such as meeting regulatory, accounting and fraud-prevention obligations and resolving disputes. When information is no longer needed, we delete or anonymise it. Information recorded on a public blockchain cannot be deleted by us (see section 6).
12. How we protect data
We use technical and organisational measures designed to protect your information against unauthorised access, loss or misuse. No system is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials and any connected wallet secure.
13. Your privacy rights
Depending on where you live, you may have rights over your personal information, including the right to access, correct or delete it, and to object to or restrict certain processing. To exercise a right, contact us at info@wagerr.app. We may need to verify your identity before acting on a request, and some information — such as on-chain data or records we must keep by law — cannot be deleted.
14. California privacy rights
If you are a California resident, the California Consumer Privacy Act (as amended) gives you the right to know what personal information we collect and how we use and share it, to request access to or deletion of your personal information, to correct inaccurate information, and not to be discriminated against for exercising your rights. We do not sell your personal information or share it for cross-context behavioural advertising. To make a request, contact us at info@wagerr.app.
15. Children
The Service is for adults only. It is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will take steps to delete it.
16. International users
We are based in the United States, and we process and store information in the United States and other countries where we or our service providers operate. If you access the Service from outside the United States, you understand your information may be transferred to and processed in countries whose data-protection laws differ from those in your country.
17. Third-party services
The Service relies on and links to third parties, including public blockchains, payment and on/off-ramp providers, identity- and location-verification providers, and the Apple App Store and Google Play. Those services have their own privacy policies, and we are not responsible for their practices. Please review their policies before using them.
18. Changes to this policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the “last updated” date and, where appropriate, give you notice through the Service. Your continued use of the Service after changes take effect means you accept the updated policy.
